Breckenridge Short-Term Rental Rules Buyers Need to Know in 2026

Buying a Breckenridge property to rent short term? Understand STR zones, non-transferable licenses, current availability, annual fees and lodging taxes before you buy.

Short answer: Do not assume a Breckenridge property can legally operate as a short-term rental just because the current owner rents it. Breckenridge uses different STR zones, licenses are non-transferable when a property sells, and license availability depends on the property’s zone.

This is one of the most important due-diligence items for buyers who want rental income.

A listing may show historical Airbnb revenue. A seller may have an active license. A rental projection may assume the unit continues operating exactly as it does today.

None of those things automatically mean you, as the new owner, will receive the same short-term rental rights.

Breckenridge has multiple short-term rental zones

The Town of Breckenridge currently regulates STR licenses through four mapped categories: the Resort Properties Zone, Zone 1, Zone 2 and Zone 3.

The rules and available license counts differ by zone.

As of the Town’s July 2026 update:

Those numbers can change as licenses close, new applications are processed and policy evolves, so buyers should verify the exact status immediately before making a purchase decision.

STR licenses do not transfer with the property

This is the part buyers cannot miss.

The Town states that short-term rental licenses are non-transferable and non-refundable when a property sells.

So if the seller has a license, you cannot simply assume you inherit it at closing.

You need to identify the property’s STR zone, check current license availability and determine whether you can obtain the license necessary for your ownership plan.

That is why I would never rely solely on an Airbnb projection or a line in the listing description.

Annual fees matter too

A Breckenridge accommodation unit license has an annual license fee based on bedroom count.

The Town also currently charges an annual $756 regulatory fee per bedroom or studio.

For a buyer comparing multiple properties, these are not the biggest expenses in the overall ownership picture, but they still belong in the underwriting.

More importantly, the existence of the licensing system reinforces the point: STR operation is a regulated use, not an automatic right attached to every residential property.

Lodging is subject to a 12.275% combined tax rate

For short-term lodging within the Town of Breckenridge, the current combined sales and accommodations tax rate is 12.275%.

In many transactions, taxes are collected through platforms or licensed property managers, but owners need to understand the total guest-facing price.

If your advertised nightly rate is $600, the guest’s checkout total may be meaningfully higher after lodging taxes and platform-related charges.

That matters when evaluating what nightly rate and occupancy the market will realistically support.

Buyers also need to know about Breckenridge’s real estate transfer tax

Breckenridge imposes a 1% Real Estate Transfer Tax on transfers of property within the Town unless a specific exemption applies.

The Town states that the buyer or grantee is responsible for the tax.

On a $1 million purchase, 1% equals $10,000.

That is a closing-cost item buyers should account for separately from down payment, furnishing, renovations and normal transaction expenses.

The due-diligence checklist I would use

Before purchasing a Breckenridge property with short-term rental income in mind, verify:

The exact jurisdiction. Is the property actually within the Town of Breckenridge or in unincorporated Summit County?

The STR zone. Use the Town’s map or confirm directly with Town staff.

Current license availability. Do not rely on what was true six months ago.

Whether the seller’s license terminates at closing. Assume it does not transfer unless the relevant authority confirms otherwise.

HOA restrictions. A municipality may allow rentals while the HOA restricts them.

Actual rental history. Look at real statements rather than only projected revenue.

All operating expenses. Management, HOA, insurance, utilities, maintenance, furnishing, taxes and reserves belong in the analysis.
